A car accident on Arnold Mill Road near the Fulton-Cherokee County line has claimed the life of a Woodstock woman. Sylvia England, a 66-year-old resident of Woodstock, Georgia was killed in a head-on collision with Kristen Mitchell, who is also a Woodstock resident. Ms. England died at a local Atlanta area hospital after being transported there for treatment of her injuries. Ms. Mitchell was treated at the same hospital for non-life threatening injuries. According to police, the investigation into the cause of the crash is ongoing. The police will use statements from eyewitnesses, if there are any, as well as the physical evidence from the accident scene, to determine who was at fault. Once police have determined who caused the crash, each driver's insurance company may use the findings of the investigation to determine who is liable for the damages caused by the accident. The insurance companies could also conduct their own investigation and make their own determine of who was at fault.
If the surviving driver was the one who caused the accident, the deceased driver's surviving family members may have a wrongful death claim for damages related to her death. If the deceased driver is determined to be at fault, the surviving driver could still have a claim for damages, which would be covered by the deceased driver's insurance policy.
