$400,000 Recovered After Car Crash Caused Hip Labral Tear Requiring Surgery

Our client was stopped in a right-turn lane in Forsyth County when another driver rear-ended her.

She hired a lawyer who demanded the at-fault driver's $300,000 policy limits, but even with more than $100,000 in medical bills, the most the at-fault party’s insurance company would offer was $50,000. At that point, her attorney partnered with The Champion Firm to file suit.

After giving the client more time to finish treatment—including surgical repair of her torn labrum in her right hip, disc herniations in her cervical and lumbar spine, physical therapy, and a diagnosis of post-concussion syndrome—we filed suit.

We built her case by assembling and analyzing her complete medical records, speaking directly with her treating physicians, serving targeted written discovery, and noticing the at-fault driver's deposition.

Our investigation revealed something the insurance company had not volunteered: The at-fault driver had been involved in a strikingly similar collision shortly before this one. We also confirmed with her doctors that they agreed all her injuries related to the crash.

Shortly before our client's scheduled deposition, we sent a renewed demand letter with our client’s updated records and our updated findings to the at-fault driver’s insurance.

The at-fault driver's insurer tendered its full $300,000 policy before a single deposition was taken.

The morning our client was scheduled to be deposed, the underinsured motorist carrier offered its full $100,000 limits.

In the end, the total recovery amount for our client was every dollar of insurance available to her, and eight times the original offer: $400,000.

Attorneys Brendan Krasinski and Rebecca Clements represented our client in this matter.
