In this case, our client was driving her car on Burnt Hickory Road in Cobb County, GA. She came to a stop in her vehicle, but a large Ford Super Duty truck driving directly behind her did not, and the truck driver slammed into the back of our client’s car, causing the entire back windshield of the car to shatter.
Our client was left with a brain injury as a result of the wreck, suffering from a concussion and developing a tegmen defect from the impact. Our client sought medical treatment the same day as the wreck, as well as received follow-up care for her injuries from an orthopedic doctor as instructed by medical providers. The tegmen defect required major surgery to repair.
The insurer disputed causation, claiming that our client’s pre-existing conditions caused her tegmen defect, not the wreck. We were able to prove that the wreck did cause the injury, and the need for surgery, by producing our client’s prior medical records that showed the absence of any symptoms consistent with a tegmen defect. We also obtained an affidavit from our client’s treating doctor, who provided the opinion that the wreck caused the tegmen defect and the need for surgery.
After negotiations with the defendant’s insurance company, we were able to obtain a $510,000 settlement for our client without having to file a lawsuit.
