$100,000 Policy-Limits Settlement Won in Red-Light Car Crash

In this case, our client was injured when another driver blew through a red light, crashing into the front-end driver’s side of our client’s vehicle. The insurance company for the at-fault driver provided a liability determination stating that our client was 15% at fault because “he has a duty to pay due attention before entering an intersection.”

Our client had been traveling west on E Crogan Street in Gwinnett County, approaching an intersection. At the intersection, another driver failed to stop for the red light, and crashed into our client’s car, hitting the vehicle so hard that our client’s head hit the steering wheel in the impact. A witness saw the incident happen and confirmed that our client had a green light and the other driver had sped through his red light. 

Our client sought medical care at the emergency department after the crash, presenting with severe headaches, lightheadedness, dizziness, neck pain, and face pain. After being treated at the hospital, our client attempted to manage his pain at home. However, he later went to an orthopedic doctor, where he complained of pain in his head and upper extremities. An MRI showed protrusions of the C3-C4 and C7-T1 discs. Our client was prescribed a cervical epidural steroid injection, an invasive procedure, and received several such injections following the accident.  

As he continued to experience concussion symptoms, our client also sought treatment from a neurologist who noted that he experienced daily headaches and pain, as well as blurry vision, dizziness, and nausea. He also experienced memory loss, anxiety, and irritability. His symptoms were signs of a traumatic brain injury (TBI). At the end of his medical treatment, our client’s medical bills were $37,520.65.
