$500,000 Recovered After Distracted Driver Sends Child to Trauma Hospital with TBI

On April 22, 2023, our client was driving on Roswell Road in Fulton County and came to a stop while waiting to make a left-hand turn into a private driveway. Our client’s 10-year-old daughter was sitting in the left rear corner of the vehicle’s backseat.

As our client stopped, another driver, who was traveling directly behind our client, glanced down at his cell phone and failed to see our client stop.

As a result of the other driver’s recklessness, he violently hit our client’s vehicle from behind, causing an impact so severe that the responding EMS providers noted there were at least two feet of intrusion into the rear of the vehicle, where our client’s daughter had been seated.

She was transported to a major pediatric trauma hospital in Atlanta where she was diagnosed with a severe traumatic brain injury (TBI), compound right frontal skull fracture, anterior and middle cranial fossa basilar skull fractures, and other serious injuries.
