In 2019, an out-of-state lawyer who represented a client injured in a Georgia car accident contacted attorney Darl Champion to pursue a lawsuit after settlement negotiations with the insurance company came to a halt. Our client was driving a pick-up truck when a driver rear-ended him in Coweta County, Georgia.
Because our client was in a large truck, his vehicle had minimal damage. Based on the lack of significant property damage to his truck, the insurance company was refusing to settle, contending that this crash could not have possibly caused the client’s back and neck injuries. As a result, a lawsuit needed to be filed to pursue the claims before the two-year statute of limitations expired.
Working on a deadline, within weeks of being hired to pursue the case, Darl filed a lawsuit against the defendant in the State Court of Coweta County in late 2019. During discovery, Darl was able to show that this was actually a significant impact because the other driver’s car was totaled.
Photographs were discovered that showed the entire front end of the defendant’s car was destroyed. Darl was able to show that this wreck did in fact cause our client’s back and neck injuries, which had led to a surgical recommendation to treat the low back problems.
Darl was able to obtain both the liability insurance policy limits of $100,000, as well as our client’s $100,000 uninsured motorist policy limits for a total settlement of $200,000.
