$130,904 Policy Limits Settlement for DUI Crash

Our client, a retired military veteran from Texas who was visiting family in Atlanta, was hit head-on when a driver in the opposite lane lost control of their vehicle and swerved into our client’s lane. When the police came on to the scene, they determined the at-fault driver was intoxicated.

Our client was driving a rental car at the time. Her airbags went off and her car was totaled. She was taken to Grady Memorial Hospital where she was diagnosed with a concussion, neck and back injuries, abrasions on her arms, and bruising on her knees and legs. Our client followed up with an orthopedic doctor when she returned to Texas for treatment of the injuries to her neck and back and right wrist. She also received chiropractic treatment and physical therapy. After more than six months of medical treatment, her medical bills were over $50,000.

The Champion Firm recovered the full liability policy limits of $25,000 less than 90 days after the accident happened, as well as the remaining policy limits of $5,904 for property damage based on a punitive damages claim (the remaining property damage limits were paid to the rental car agency for the damage to the vehicle).

Next, The Champion Firm pursued our client’s uninsured motorist (UM) policy with USAA.

Due to her injuries and growing medical expenses, our team sent a demand for the full limits of $100,000. USAA initially responded with an offer of $40,000. We quickly filed a lawsuit based on the low offer. Shortly after filing suit, USAA agreed to accept our policy limits demand of $100,000.

In total, The Champion Firm team was able to recover $130,904 for our client in less than a year.
