A pedestrian accident on 17th Street in Atlanta caused serious leg injuries to three people. The accident started when an SUV rear-ended another car. When the people from that accident got out to inspect the damage, a third car hit the stopped vehicles. The chain reaction collision caused one woman to suffer a fractured ankle, one man broke both shins, and another man broke one shin. It is unclear what caused either the first accident or the second one. It is possible that one of the drivers was distracted, intoxicated, or was just following too closely. Police will determine who was at fault, but it appears that the second driver will bear most of the blame. He or she would have likely had enough time to see the stopped vehicles and avoid them if the people from the first accident were stopped long enough to get out of their vehicles.

On top of that, the second collision is what caused the most serious injuries. If the driver that caused the second collision does not have enough insurance to pay everyone’s damages, the injured individuals will be able to make claims for their own uninsured motorist (“UM”) coverage, even though they were not in their cars at the time. This is because UM coverage protects you regardless of whether you are in a car, as long as the at-fault driver either has no insurance or not enough insurance to pay all of your damages.

This case highlights the importance of always being vigilant on the roadways. If you are involved in an accident, make sure you are in a position of safety. You never know when you will encounter an irresponsible driver who could inflict serious injury on you if you are not protected inside of your car.
