$50,000 Policy Limits Settlement for Contested Liability Car Accident

$50,000 Policy Limits Settlement for Contested Liability Car Accident

In October of 2021 our client was driving in Fulton County, GA when she was rear-ended by another vehicle. An accident had occurred in the opposite lane and our client had slowed down as she passed the accident scene.

Atlanta police cited both our client for impeding the flow of traffic and the other driver for following too closely. Due to this, the at-fault’s insurance company, Progressive, claimed that this was a 50/50 liability case and refused to pay for any of our client’s damages or injuries.

Our client suffered severe soft tissue injuries with debilitating pain in her back, shoulder and neck. After an initial evaluation at the ER, she followed up with an orthopedist who recommended joint injections, physical therapy and chiropractic treatment.

Attorney Eric Funt argued that our client was not liable for the wreck and due to her medical bills and property damage, sent a demand for the liability policy limits of $25,000. The client’s medical bills alone exceeded that amount. Due to our strong, thorough demand process, the at-fault's insurance agreed to pay the policy limits immediately.

One of the challenges of this case was that the liability limits were insufficient to compensate our client for her injuries, so The Champion Firm, Personal Injury Attorneys, P.C. pursued UM through our client’s personal policy.

Eric was able to convince the UM carrier both of the at-fault driver's liability, and the seriousness of our client’s soft tissue injuries. In the end, our team succeeded in recovering the full UM policy limits of $25,000 — for a total settlement of $50,000.

About one in eight Georgia drivers on the road do not have auto insurance according to the Insurance Information Institute. If another driver causes a collision with you or a member of your family, there is a chance that the person at fault will have little or no liability insurance.

Uninsured and underinsured motorist (UM) coverage protects policyholders who are hurt in a crash involving an uninsured, underinsured or hit-and-run driver.
