Settlement for False Cancer Diagnosis

The Champion Firm discovers Pathology Lab Error which lead to False Cancer Diagnosis Resulting in Confidential Settlement for Client

The Champion Firm was hired to represent a client who had part of her liver and her entire gallbladder removed after a false positive diagnosis of cancer. The problem started when a mass was noted in our client’s liver during a routine imaging study. To further evaluate the mass, her doctor had it biopsied to determine if it was malignant or benign. The biopsy was conducted and came back with a diagnosis of cancer in her liver. As a result, the mass had to be removed, and our client underwent a major surgery that led to weeks in the hospital and numerous complications.

The mass was sent for further evaluation after it was removed. The results came back that it was benign, meaning our client never had cancer to begin with. Our client hired us to investigate the claims and determine how this could have happened. Our investigation revealed that there was a problem with the pathology lab that resulted in our client’s biopsy sample being tainted by another patient’s sample, who did have malignant cells in her biopsied tissue.
