In this case, our client was driving on S. Rockbridge Road in Gwinnett County when she came to an intersection and stopped at a stop sign.
The driver following directly behind our client, however, did not stop and crashed into the rear of our client’s vehicle. The at-fault driver was cited for following too closely, in violation of O.C.G.A. § 40-6-49.
As a result of the collision, our client experienced continuous pain in her neck and upper back, as well as recurring headaches. She went to Piedmont Rockdale Hospital, where she was diagnosed with muscle, fascia, and tendon strains in her neck; muscle and tendon strains in her back; and acute post-traumatic headache.
An MRI scan later diagnosed our client with cervicalgia, postconcussional syndrome, and thoracic spine pain, among other injuries.
Despite following the treatment protocols she was prescribed, our client experienced little improvement in her injuries, even several months after the crash occurred. She had to undergo several rounds of bilateral branch block injections in an effort to treat her injuries.
Personal injury attorney Brendan Krasinski took on this case and recovered a policy limits settlement of $125,000 for our client: $100,000 from the at-fault driver’s liability coverage and $25,000 from our client’s underinsured motorist coverage.
