The Champion Firm Files Legal Malpractice Claims for Couple Misled by Previous Attorneys

Personal injury attorneys Darl Champion and Jackson Latty are representing a Georgia couple in two related professional negligence cases that recently drew the attention of Law360.

The lawsuits, which make professional negligence allegations against two Georgia personal injury law firms, seek to recover damages from previously mishandled lawsuits by the couple’s former attorneys at Gary Martin Hays LLC and Milam Law Firm LLC.

As covered in the article by Law360, Kenneth and Julia Cameron’s former attorneys failed to sue a key liable party in a car crash injury lawsuit filed by Mr. Cameron, which left $2.5 million worth of insurance coverage out of the case.

Mr. Cameron was also advised to delay filing a legal malpractice suit against the law firms, which caused the statute of limitations for such a claim to pass. 

“He pursued exactly what they told him to do,” attorney Darl Champion told Law360 of Mr. Cameron’s interaction with his previous attorneys, “and now they're taking a completely contrary position and saying, 'Oh, too late. You should have actually sued because now the statute of limitations has run.’ It's just absurd.”

Mrs. Cameron is separately seeking to recover damages related to the mishandled case, as Gary Martin Hays LLC and Milam Law Firm LLC never filed her viable loss of consortium claim related to her husband’s injuries. 

Ultimately, our clients’ malpractice lawsuits seek justice for the mishandling of their original claims, as well as the subsequent advice to delay pursuing legal action against the firms for those oversights.

The prior firms’ recommendations to delay bringing a malpractice claim against themselves is a conflict of interest that should have been clearly disclosed to Mr. Cameron. Their failure to do so is a breach of the attorneys’ fiduciary duties.
