In this case, our client was a Criminal Investigator for the City of Senoia Police Department. She was driving her department-issued Ford F150 in Coweta County, GA when she came to a four-way intersection. After stopping at her stop sign, she proceeded through the intersection. However, another driver ran their stop sign and crashed into our client’s vehicle.
Drone-captured photos of the scene show that the other driver hit our client’s vehicle with such force that it rotated our client’s vehicle on the roadway.
Our client was taken by ambulance to Piedmont Newnan Hospital, where she was treated for pain in her left leg, shoulder, arm, and chest.
However, following the crash, she continued to experience ongoing pain throughout her body, including in her neck, low back, shoulder, and arm. Her physician also noted that he was concerned about a “large disc herniation or stenosis” in our client’s neck. Our client was sent for an MRI, which revealed a bulging disc at C5-6 with “severe bilateral neural foraminal stenosis.” In the months following the crash, she underwent steroid injections as well as an anterior cervical discectomy and fusion surgery.
In addition to the physical injuries she suffered from the crash, our client also experienced a tremendous amount of hardship and pain and suffering that significantly interfered with her life.
Personal injury attorney Michael Denney took on this case for our client, retaining a collision reconstruction expert and engineer to assess the nature and cause of the crash.
The defendant disputed fault for running the stop sign at the time of the collision. However, our team was able to track down the defendant’s vehicle, which was totaled in a subsequent collision, and we purchased the event data recorder (“EDR”) from the vehicle from a third-party salvage company.
This critical evidence allowed our expert to conduct a forensic investigation on the data contained in the EDR, which unequivocally showed the defendant failed to stop at the stop sign before the collision, and which ultimately led to the insurance companies paying their full policy limits for the incident. We successfully settled this case with the at-fault driver’s insurance for $150,000.
