Result:

$2,060,000

Case Summary:

The Champion Firm was able to recover the maximum insurance policy limits for the family of a man who was killed in a car accident while he was riding as a passenger in a rideshare vehicle. Our client was on his way to the work at the time of the wreck. The rideshare driver failed to yield while turning left at an intersection and turned in front of another car that was coming in the opposite direction, causing a t-bone collision on the passenger’s side of our client’s car. Our client died at the scene. When the police investigated the wreck, they determined that the driver of our client’s car was at fault for failing to yield while turning left and cited him for causing the wreck.

Challenges:

Instead of taking the police department’s findings at face value, The Champion Firm launched a thorough investigation to determine whether anyone else was at fault. As soon as our client’s surviving wife hired us we retained an accident reconstructionist to inspect the cars involved in the wreck and the intersection. We analyzed the car our client was in for any potential product liability claims. Darl Champion was lead counsel on the case and personally went to the intersection to video record the traffic light sequences. We talked to all the witnesses to the wreck and obtained statements from them.

Based on our investigation, we determined that our client’s rideshare driver was not the only one at fault. We were able to show that the driver of the vehicle who hit our client’s car was also partially at fault. It appeared that our client’s car, and the other car, were both trying to be beat a red light when they collided in the intersection. Consequently, we were able to show that each driver was 50% at fault.

Auto Accident Settlement:

As a result of our findings, we were able to recover far more money for our client’s surviving wife and child. If we had been unable to prove the other driver was at fault, our client’s family would have only been able to recover $1,000,000. However, due to our efforts, were able to recover damages on additional insurance policies, bringing the total financial recovery for our client’s family to a total of $2,060,000.

Case Highlights

This case highlights the importance of hiring a personal injury lawyer who will go the extra mile and do what it takes to thoroughly investigate your case. A lawyer who was interested in a quick settlement would have likely accepted the police officer’s findings and settled for far less than what we were able to recover for our client.
