Our client in this case was driving down a road in DeKalb County when an oncoming driver swerved over the double-yellow line and violently crashed into our client’s vehicle. Police responded to the crash and found the oncoming driver at fault for the wreck.
As a result of the crash, our client was injured, unable to work, and suffered ongoing mental and physical health issues. He suffered neck, back, and hip pain, and had concussion symptoms with constant headaches. In addition to the physical injuries caused by the crash, our client also developed panic attacks and increased stress.
An MRI later revealed that our client’s left hip had a partial labral tear, for which he had to undergo surgery to repair.
He also required continued treatment for his concussion symptoms, which continued to persist after the crash. A neurologist diagnosed our client with cognitive and neurobehavioral dysfunction following brain injury, multisensory dizziness, intractable chronic post-traumatic headache, transient disorder of initiating or maintaining sleep, and adjustment disorder with anxious mood.
Attorneys Darl Champion and Bill Daniel filed suit in the county where the at-fault driver resides. After proving that the other driver failed to use ordinary care in the operation of her vehicle, the liable driver’s insurance agreed to settle for $300,000.
