In this case, our clients were a husband, wife, and their six-month-old daughter. The family was traveling southbound on US-27 in Marion County, Florida, when another driver traveling northbound lost control, crossed the center median, and entered oncoming traffic.
After striking another vehicle, that driver’s car rotated into the path of our clients’ vehicle, resulting in another collision and disabling damage. The investigating officer determined that the other driver caused the multi-vehicle crash and cited him for careless driving.
All three members of our clients’ family were transported by ambulance to a local hospital following the crash.
The father experienced significant neck and lower back pain, along with a laceration to his lip. His symptoms continued after the collision and eventually included reduced mobility, sleep difficulties, and intermittent numbness in his leg. He underwent additional evaluation and physical therapy, but continued to experience pain into the following year.
The mother suffered a head injury and cervical sprain and later reported that she had lost consciousness during the crash. She continued to experience headaches, dizziness, vision changes, neck and shoulder pain, and balance problems and was diagnosed with a traumatic brain injury and post-concussion syndrome. Although her headaches improved with treatment, she continued to experience lingering vestibular symptoms.
Our clients’ infant daughter also struck her head during the collision despite being properly secured in a rear-facing car seat. She sustained an abrasion to her forehead and underwent emergency evaluation and follow-up care with her pediatrician.
The at-fault driver did not have bodily injury liability insurance, making this an uninsured motorist claim.
