In this case, our client was attempting to make a left turn from North Point Parkway onto Mill Creek Avenue in Fulton County, Georgia. At the same time, another driver traveling northbound on North Point Parkway ran a red light and crashed into the passenger side of our client’s vehicle.
The at-fault driver later admitted to the responding officer that she had been "zoning out" and failed to stop for the traffic signal. The investigating officer determined that she was at fault for the collision. The impact caused significant damage to both vehicles.
Following the crash, our client was transported by ambulance to Wellstar North Fulton Hospital, where he was treated for serious injuries. Imaging revealed a fractured left clavicle and multiple rib fractures. He was admitted to the hospital for observation and treatment due to the severity of his injuries and his pre-existing heart condition.
In the weeks that followed, our client continued to experience significant shoulder pain and limited mobility. Follow-up imaging confirmed the clavicle fracture, and he was referred for orthopedic care. Surgery was considered as a treatment option, but his underlying heart condition prevented him from moving forward with a surgical procedure.
As his recovery continued, our client underwent extensive physical therapy to address his ongoing shoulder pain and functional limitations. Despite treatment, he continued to experience symptoms. Further evaluation later revealed additional injuries, including a torn rotator cuff and a SLAP tear in his shoulder, both of which may require surgery in the future.
The collision also affected our client’s underlying cardiac condition. According to his treating cardiologist, the crash exacerbated existing heart-related issues, requiring changes to his medications, additional testing, and specialist care.
Attorneys Brendan Krasinski and Rebecca Clements represented our client in this case. Rebecca recovered $50,000 from the at-fault driver’s insurance and, when our client’s own uninsured motorist carrier contested responsibility, Brendan joined the case and filed suit against the UM carrier. Combined, our legal team secured a combined $150,000 total settlement for our client.
