In this case, our client was riding his motorcycle eastbound on Georgia Highway 136 in Dawson County when another oncoming motorcyclist crossed the center line and collided with our client’s motorcycle. Both riders claimed the other crossed the center line.
Our client was transported by ambulance to the hospital with a significant laceration to his left foot, severe pain in both feet, and pain in his wrist.
Imaging revealed multiple fractures in his left foot, and his doctors were also concerned about swelling and inadequate blood flow to his first and second toes, prompting his transfer by medical helicopter to another hospital for additional evaluation.
Our client initially could not comfortably bear weight on his left toes, delaying the start of his physical therapy. His mobility became limited enough that a stairlift was ordered to help him navigate his home.
Once he was able to begin rehabilitation, our client underwent months of physical therapy. He made progress, but continued to have difficulty with activities including climbing stairs, lifting heavy objects, and performing strenuous household tasks. He also developed lower back pain while dealing with the prolonged limitations caused by his foot injuries.
Attorneys Darl Champion and Jackson Latty represented our client in this case and retained an accident reconstruction expert, as there was a dispute over where the collision occurred.
After reviewing photographs, inspecting the other motorcycle, and examining the crash scene, the expert concluded that the collision occurred on our client’s side of the roadway, supporting our claim that the other motorcycle was the one to cross the center line and caused the wreck.
With this and other evidence to support the case, Darl and Jackson successfully secured a $525,000 settlement on our client’s behalf.
